Terms of Service

By accessing and using Manthan (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Manthan is operated by Craskey.

Manthan is a retrospective collection platform that allows organizations to gather anonymous retrospectives from their teams. The Service includes:

• Creating retrospective boards
• Collecting anonymous submissions
• Voting and engagement features
• Analytics, insights, and pattern detection
• Content moderation tools

You agree not to use Manthan for any of the following:

• Illegal activity: Any use that violates local, national, or international law.

• Harassment or abuse: Threatening, intimidating, or abusive language directed at individuals or groups.

• Hate speech: Content promoting discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.

• Doxxing: Sharing personal information (real names, addresses, phone numbers, etc.) to identify contributors.

• Spam: Repeated, unsolicited, or commercial content.

• Misinformation: Deliberately false or misleading statements intended to deceive.

• Confidential information: Sharing proprietary, trade secret, or confidential company information.

• Sexual or explicit content: Pornographic or sexually explicit material.

• Malicious code: Attempting to inject code, malware, or exploit vulnerabilities.

• Impersonation: Pretending to be someone else or misrepresenting your identity.

• Automated review: Manthan uses AI moderation (Groq) to automatically flag potentially inappropriate content.

• Manual review: Our team may review flagged content and remove violations at our discretion.

• No guarantees: While we strive to keep the platform safe, we cannot guarantee all inappropriate content will be caught.

• Right to remove: We reserve the right to remove any content we deem to violate these terms, without advance notice.

• Manthan IP: The Manthan platform, design, and code are owned by Craskey. You may not reproduce, modify, or redistribute them.

• Your content: You retain all rights to retrospectives you submit. By submitting retrospectives, you grant Manthan a license to display, store, and analyze them within the Service.

• Retrospective usage: Workspace admins own the retrospectives on their boards. Retrospectives are not shared publicly unless admins choose to export or share them.

We do not guarantee:

• Uninterrupted or error-free service
• That all inappropriate content will be caught by moderation
• That anonymity will never be compromised
• That data will never be lost or corrupted

Use the Service at your own risk.

To the fullest extent permitted by law, Craskey and Manthan will not be liable for:

• Indirect, incidental, consequential, or punitive damages
• Loss of data, revenue, profits, or business opportunities
• Any damages arising from your use of or inability to use the Service

Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is less.

You agree to indemnify, defend, and hold harmless Craskey, Manthan, and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these terms
• Your violation of any law or third-party rights
• Content you submit or actions you take on the Service

• Your right: You can delete your account and stop using Manthan at any time.

• Our right: We may suspend or terminate your account if you violate these terms or engage in illegal activity.

• Data after termination: Upon account deletion, your data will be retained for 30 days, then permanently deleted.

• Data export: Before deletion, you can request an export of your boards and retrospective data.

We may update these Terms at any time. Material changes will be communicated to you via email or a notice on the Service. Your continued use of Manthan means you accept the updated terms.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Manthan regarding your use of the Service and supersede all prior agreements or understandings.
